Big Changes 18 April 2025 with HR 2025-59 Real Estate Law
Thinking of buying or selling a home in Alabama this year?
There’s a new law going into effect that directly impacts how you work with real estate agents — and it’s designed to give you more freedom, more transparency, and more control during the process.
In this post, we’ll break down what Alabama Act 2025-59 means for both buyers and sellers, how it came to be, and what you need to watch for starting April 18, 2025.
📜 The Backstory: Why This New Law Exists
In the last 18 months, major lawsuits and a Department of Justice investigation rocked the real estate industry. A nationwide settlement involving the National Association of REALTORS® (NAR) created new rules that required buyers to sign contracts before touring homes — even in Alabama.
This confused a lot of people — and raised concerns about fairness, consumer choice, and transparency.
So Alabama lawmakers stepped in.
Thanks to strong advocacy and support from industry professionals, HB230, now Alabama Act 2025-59, was passed to bring clarity and consistency to the home buying and selling process across the state.
👥 What This Means for Home Buyers
Under the new law, you don’t have to sign a binding contract just to view a home.
Here’s how it protects you:
You can meet with agents, ask questions, and view homes before committing to anything.
A written agreement is only required before submitting an offer to purchase a property.
You’ll receive a clear explanation of how your agent is paid — so there are no surprises.
🏠 What This Means for Home Sellers
If you’re listing your home, the new law ensures that:
Your agent provides a written agreement before listing your property.
You understand the terms of compensation and services upfront.
Referral agreements between agents are put in writing to protect everyone involved.
📅 When Does the New Law Take Effect?
April 18, 2025.
Until then, business continues as usual — but after that date, all Alabama real estate licensees (not just REALTORS®) must follow the new requirements.
🛡️ Why This Matters for You
Whether you’re buying your first home, selling your third, or just starting to explore your options — this law is about protecting your interests. You deserve clear communication, fair terms, and the ability to choose when and how you commit to working with an agent.
